INFORMATION TO DATA SUBJECTS AND THEIR RIGHTS ex D.Lgs. 196/2003 Gizeta Calze S.r.l., with its headquarters in Castel Goffredo (MN), Viale Francia 2, as the Controller of the handling of personal data, wish to inform you that your personal details will be processed in accordance with the rules set up by the Italian Data Protection Code (Legislative Decree n. 196/2003). 1) 'Processing' shall mean any operation, or set of operations, carried out with or without the help of electronic or automated means, concerning the collection, recording, organisation, keeping, interrogation, elaboration, modification, selection, retrieval, comparison, utilization, interconnection, blocking, communication, dissemination, erasure and destruction of data, whether the latter are contained or not in a data bank. 2) Purposes. Personal Data will be processed: a) solely to allow Gizeta Calze S.r.l. to achieve its business goals and to manage business relationship with all the Company's Stakeholders such as customers, personnel, suppliers, consultants, etc. b) to comply with laws or regulations or Community Legislation. c) if the Data Subject gives his written consent, for the purpose of sending advertising materials or direct selling or else for the performance of market or for any other commercial communication surveys. 3) Ways of Processing Data. Personal Data Processing can be done manually or with electronic means in order to achieve the described purposes. The data shall be reproduced on paper or magnetic media, or else transmitted via electronic networks, whenever this is requested. In any case, the data will be : processed lawfully and fairly; collected and recorded for specific, explicit and legitimate purposes and used in further processing operations in a way that is not inconsistent with said purposes; accurate and, when necessary, kept up to date; relevant, complete and not excessive in relation to the purposes for which they are collected or subsequently processed; kept in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the data were collected or subsequently processed. 4) Voluntary Nature of providing data. Providing data for the purposes stated above is voluntary but it can be necessary for corporate, legal or tax requirements. If he/she fails to provide, entirely or partly, the data required the contract or the purposes mentioned on 2) could not be performed. 5) Place of Data Processing. The data processing is done at Gizeta Calze S.r.l. Headquarters. 6) Data Processors. The Data will be processed by Gizeta Calze S.r.l. personnel (hereinafter Data Processors) designated by the Data Controller on the basis of Section 30 of D.Lgs. 196/2003. An updated list of Data Processors is available at the Company Headquarters. 7) Entities or categories of entity to whom or which the data may be communicated. The Data can be communicated, if needed, to Banks or Financial Corporations for cash flows management, to freight and logistic companies to deliver or receive the goods, to Gizeta Calze S.r.l. consultants for tax or legal requirements, to Credit Insurance Companies, to Audit Firms and to companies in charge of managing and maintaining Gizeta Calze S.r.l. Information System. Apart from what stated above, the Data will not be disseminated, if not required to be in compliance with an obligation imposed by a law, regulations or Community legislation; 8) Data Subject's Rights. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form. 8.1) A data subject shall have the right to be informed: a) of the source of the personal data; b) of the purposes and methods of the processing; c) of the logic applied to the processing, if the latter is carried out with the help of electronic means; d) of the identification data concerning data controller, data processors and the representative designated as per Section 5(2) of the Data Protection Code; e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State's territory, data processor(s) or person(s) in charge of the processing. 8.2) A data subject shall have the right to obtain a) updating, rectification or, where interested therein, integration of the data; b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. 8.3) A data subject shall have the right to object, in whole or in part, a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys. The rights referred above may be exercised by making a request to the data controller or processor without formalities, also by the agency of a person in charge of the processing.
